ACCEPTANCE OF TERMS
These Terms of Use ("Terms") govern your use of the Kangastop website located at www.kangastop.com (the "Website") and the supply of products and services by Kangastop Pty Ltd. By accessing the Website or engaging with us for the purchase of products or services, you agree to be bound by these Terms.
If you do not agree with these Terms, please do not use the Website or engage us for the supply of products or services.
These Terms should be read together with our Privacy Policy and, where applicable, our Warranty Policy. In the event of any inconsistency, these Terms prevail.
Note: These Terms apply to both website visitors and customers purchasing Kangastop products. Separate sections address website use and product supply respectively.

ABOUT US
The Website is operated by Kangastop Pty Ltd (ABN 35 674 056 403) ("Kangastop", "we", "us", or "our"), an Australian company with its principal place of business at Unit D2A, 81 Riverstone Parade, Richards (Riverstone) NSW 2765.
Kangastop designs and manufactures CNC motorised measuring systems for cutting, punching, and repetitive measurement production, sold under the Kangastop brand.

PERMITTED USE
You may use the Website for lawful purposes only and in accordance with these Terms. Permitted use includes browsing product information, obtaining quotations, and contacting us for genuine business enquiries.

All content on the Website - including text, images, photographs, graphics, logos, product designs, technical specifications, and software - is the property of Kangastop Pty Ltd or its licensors and is protected by Australian copyright law and, where applicable, trademark and design law.

PRODUCT INFORMATION AND ACCURACY
We take reasonable care to ensure that information about our products - including specifications, pricing, availability, and features - is accurate and current. However, we do not warrant that product information on the Website is complete, accurate, or up to date at all times.
Product specifications, pricing, and availability are subject to change without notice. The current and binding information for any specific order is that confirmed in writing by Kangastop at the time of accepting your order.
Images of products on the Website are for illustrative purposes only. Actual products may differ slightly in appearance from images shown. Dimensions and weights shown are indicative and subject to confirmation.

QUOTATIONS AND ORDERS
QUOTATIONS
Quotations provided by Kangastop are valid for 30 days from the date of issue unless otherwise stated in writing. Quotations are subject to availability at the time of order and do not constitute a binding offer until accepted in writing by Kangastop.
PLACING AN ORDER
An order is placed when you communicate your acceptance of a quotation in writing (by email or letter). Kangastop reserves the right to accept or decline any order at its discretion.
A binding contract for the supply of products is formed when Kangastop provides written confirmation of your order, including confirmation of the product specification, price, and estimated lead time.
ORDER CHANGES
Requests to change an order after written confirmation should be made as soon as possible by contacting us directly. We will attempt to accommodate changes but cannot guarantee this once production has commenced. Additional charges may apply to order changes.

PRICING AND PAYMENT
PRICES
All prices quoted by Kangastop are in Australian Dollars (AUD) and exclude Goods and Services Tax (GST) unless expressly stated otherwise. GST will be added to the quoted price and will be shown separately on your invoice.
Prices do not include freight, delivery, or installation costs unless expressly included in your quotation. These charges will be confirmed in your quotation or order confirmation.
PAYMENT TERMS
Our standard payment terms are a 50% deposit upon order confirmation, with the balance payable prior to or upon delivery, unless alternative terms are agreed in writing. We reserve the right to require full payment in advance from new customers or for custom orders.
Payment may be made by direct bank transfer (EFT) or as otherwise agreed. Our bank details will be included on your invoice.
OVERDUE PAYMENTS
If any amount is not paid by the due date, we may suspend performance of our obligations under the contract, and we reserve the right to charge interest on overdue amounts at the rate of 10% per annum calculated daily from the due date until payment is received in full.

DELIVERY AND INSTALLATION
DELIVERY
Estimated lead times and delivery timeframes will be provided in your quotation or order confirmation. Lead times and delivery timeframes are estimates only and are not guaranteed. Kangastop will take reasonable steps to meet estimated timeframes but will not be liable for delays caused by factors outside our reasonable control, including freight delays, supplier delays, or force majeure events.
Risk in products passes to you upon delivery to your nominated delivery address. Title to products passes to you upon receipt of payment in full.
DELIVERY ADDRESS
It is your responsibility to ensure that the nominated delivery address is accurate, accessible, and that an appropriate person is available to receive delivery. Re-delivery charges may apply if delivery cannot be completed due to circumstances within your control.
INSPECTION ON DELIVERY
You should inspect all products upon delivery and notify us of any obvious damage or discrepancy within 48 hours of delivery. Failure to notify us within this period may affect your right to make a claim for transit damage. This does not affect your rights under the Australian Consumer Law or the Kangastop product warranty.
INSTALLATION
Where installation services are engaged, the scope of installation will be agreed in writing prior to commencement. You are responsible for ensuring the site is prepared, accessible, and safe for installation work. Any variation to the agreed installation scope may attract additional charges.

RETURNS AND CANCELLATIONS
CUSTOM AND MADE-TO-ORDER PRODUCTS
All Kangastop products are manufactured to order. As such, we generally do not accept returns or cancellations once production has commenced, except where required under the Australian Consumer Law (see Section 12) or the product warranty (see Section 10).
CANCELLATIONS BEFORE PRODUCTION
If you wish to cancel an order before production has commenced, please contact us immediately. We will advise whether cancellation is possible. Where cancellation is accepted prior to production, your deposit may be refunded less any costs already incurred by Kangastop in relation to your order (including design, engineering, and administration costs).
WARRANTY RETURNS
Returns arising from warranty claims are handled in accordance with our Warranty Policy. Please contact us directly to discuss any warranty concern.
CHANGE OF MIND
We do not accept returns or provide refunds for change of mind. We strongly encourage customers to seek a factory demonstration or Zoom walkthrough prior to purchasing to ensure the product is right for their needs.

PRODUCT WARRANTY
All Kangastop products are covered by our industry-leading 10-year warranty covering both parts and labour. Full warranty terms are set out in our Warranty Policy, which forms part of these Terms.
In summary, the warranty covers defects in materials and workmanship for 10 years from the date of purchase. It does not cover damage caused by misuse, accident, unauthorised modification, or improper installation by the customer.

LIMITATION OF LIABILITY
WEBSITE
To the maximum extent permitted by law, Kangastop excludes all liability for any loss or damage (including direct, indirect, consequential, or incidental loss) arising from your use of, or inability to use, the Website or any content on the Website.
PRODUCTS AND SERVICES
To the maximum extent permitted by law, and subject to the Australian Consumer Law (Section 12), Kangastop's total liability to you in connection with the supply of products or services - whether in contract, tort (including negligence), statute, or otherwise - is limited to the amount paid by you for the specific product or service giving rise to the claim.
In no event will Kangastop be liable for:

Loss of profits, loss of revenue, or loss of business opportunity

Loss of production or downtime costs (except where specifically covered under the warranty)

Indirect, consequential, special, or punitive damages of any kind
Important: Nothing in these Terms excludes, restricts, or modifies any right or remedy, or any guarantee, warranty, or other condition, that is conferred upon you by the Australian Consumer Law and cannot be excluded by agreement. See Section 12.

AUSTRALIAN CONSUMER LAW
Our products come with guarantees that cannot be excluded under the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010 (Cth)).
You are entitled to a replacement or refund for a major failure and for compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
Nothing in these Terms is intended to exclude, restrict, or modify your rights under the Australian Consumer Law. Where there is any inconsistency between these Terms and the Australian Consumer Law, the Australian Consumer Law prevails to the extent of the inconsistency.

The Website may contain links to third-party websites (for example, links to Google Maps, our component suppliers, or the Australian Made website). These links are provided for convenience only. Kangastop does not endorse, control, or take responsibility for the content of any linked third-party website.
Accessing third-party websites through links on the Kangastop Website is at your own risk. We encourage you to review the terms and privacy policies of any third-party websites you visit.

PRIVACY
Your use of the Website and our handling of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.
By using the Website or providing us with personal information, you consent to our collection and use of that information in accordance with our Privacy Policy.

GOVERNING LAW AND JURISDICTION
These Terms are governed by the laws of New South Wales, Australia. You and Kangastop submit to the non-exclusive jurisdiction of the courts of New South Wales for the resolution of any dispute arising under or in connection with these Terms.
We encourage you to contact us directly to resolve any dispute informally before commencing formal proceedings. Most issues can be resolved quickly through direct communication.

CHANGES TO THESE TERMS
We may update these Terms from time to time to reflect changes in our practices, products, legal obligations, or business operations. When we make changes, we will update the "Last updated" date at the top of this page.
Continued use of the Website after any change to these Terms constitutes your acceptance of the updated Terms. We encourage you to review these Terms periodically.
For any order placed prior to an update to these Terms, the Terms in effect at the time of order confirmation will apply to that order.
